Background and rational
The African Charter on the Rights and Welfare of the Child (the Charter) mandates the African Committee of Experts on the Rights and Welfare of the Child (ACERWC/the Committee) to consider State Reports on the implementation of the Charter. This mandate is given under Article 43 of the Charter, where State Parties are expected to submit a report on the measures taken to give effect to the provisions of the Charter and the progress in the enjoyment of the rights. Every State Party to the Charter should submit report on the implementation of the Charter within two years of the entry in to force of the Charter for the concerned State Party and every 3 years thereafter.
The procedure of consideration of State Reports commences with a State Party submitting written report on the measures taken for the implementation of the Charter, referred to as the State Report. Following receipt of the State Report, the ACERWC receives a Complementary CSO report on the implementation of the Charter by the State Party. The Committee first considers the CSO report and drafts list of issues, which are clarifications, sought from the State Party on the implementation of the Charter. The State Party may reply to the list of issues in writing. Regardless, the Committee’s next step is to invite the State Party to present its report and engage in a constructive dialogue during its Session.
Following the process of consideration of a State Report, the Committee issues Concluding Observations and Recommendations to the State Party. The aim of the Concluding Observations and Recommendations is to acknowledge the positive measures undertaken by the State Party in implementation of the Charter, to highlight areas of concern and to guide the State Party towards ensuring full implementation of the rights contained in the Charter. Within two years after issuing the Concluding Observations and Recommendations to the State Party, the Committee undertakes follow up missions to analyze the progress made in implementing the recommendations.
Beyond their primary purpose of monitoring the implementation of the Charter, State Reports and Concluding Observations and Recommendations are valuable resources to all stakeholders working on child rights and welfare. They serve as source of information for policy makers, academicians, civil society organizations and children. They can be used as a tool to evaluate the situation of children’s rights and welfare in a State Party, as they provide a holistic assessment of the status of civil, political, economic and social rights enshrined in the Charter.
The Committee has so far issued 38 Concluding Observations and Recommendations to initial and periodic reports of State Parties. Plan International Pan Africa Office (Plan PAO), as one of the key partner for ACERWC, has been supporting and strengthening the capacity of ACERWC to implement its mandate on state reporting, concluding observations and recommendations in materializing the rights of African children. The Concluding Observations and Recommendations are available on the website of the Committee in the form of a list. Taking in to account the increasing number of State Reports and Concluding Observations and Recommendations, the ACERWC with the technical and financial support from Plan International Pan Africa Office (Plan PAO) have decided to establish a systematic online depository of these documents, in a form of an online database.
Objective
The objective of the database is to ensure a systematic and sustainable deposit of State Reports, Concluding Observations and Recommendations of the ACERWC.
Expected Outputs
Methodology
The database should be developed as a sub-domain to the new ACERWC website, www.acerwc.africa. It should be done in consultation with the Secretariat of the ACERWC.
